Hi, I have been working for organizations for more than 3 years now. I need some help with the Salary Restructuring.

In 2012, I have received the offer letter and it had components such as Basic, HRA, Special Allowance, Transport Allowance, Medical Allowance, Night Shift Allowance, Gratuity, VIP(Variable Incentives Pay), Mediclaim, PF, Gratuity.

The corresponding deductions were Mediclaim, PF which reflected in the salary slip, However, the deduction for Gratuity is not shown in the salary slip.

After 6 months of joining the organization, I have opted out of Mediclaim. They adjusted the Mediclaim in Special Allowance and this was reflecting in the salary slip, however, I never got the revised offer letter for the same. My salary in hand was still the same and everything was fine.

In October 2013, I was moved to another project in the organization. In October 2014, the company changed the Salary structure without any prior notifications. I found that the company stopped paying the Night Shift Allowance from October 2014 salary slip. When I checked with HR, I was informed that the project does not pay Night shift allowance(Rs 1500) even though I am doing a night shift. HR explained that they have added the Night Shift Allowance to the other components in the salary structure. HR informed that they do not need to consent this with the employee because this is a company policy.

I found that there were changes made to Basic, HRA, PF, Gratuity, VIP as well. I requested the HR to adjust the Night Shift Allowance to Special Allowance rather than distributing the Night shift allowance to Basic, HRA, PF, Gratuity and VIP to ensure that there are no changes made to the in-hand salary. I also noticed that the package increased from 4,05,000 to 4,23,000 and still the in-hand salary is less.

There was not even a single instance where the company has apologized for not bringing this to my attention before making changes to the salary slip. Its been more than 5 months and I am still awaiting the revised appraisal letter of FY 2014.

This company has not even paid the VIP for more than 1 year. Please let me know if there are any legal actions to be taken against the company as an Individual.

I am not sure if this is the right place to discuss but hope to discuss this with a positive instinct.

Termination of employment by employee shall be three months in writing and one month notice by employer or upon completion of assigned project(s) w customer and manager sign off, whichever is later.
Does this mean if my notice period is 90 days and my project ends in 45 days, the company can let me go?
Do I get any compensation for the remaining days?

The matters of compensation to employees are sensitive.The company should have intimated to you about the changes in your salary structure.However it is also important to note that, on what terms of service agreement you have accepted the employment with the company.Your appointment letter will clearly speak about such terms.More importantly the company keeps their rights reserved on various policy matters and employees can raise their grievances through proper channel and can seek remedy on their problems.You have to be careful in understanding the procedures for remedy of grievances
Suggest to have ample of home work on your problems and try to sought it out amicably.There is certainly way out.
