I am working as a Marketing Manager in a steel structures and components manufacturing company.
3 months back our company executed one project in our city. After completion of project the client is delaying balance payment of Rs 300000 (Three Lacs). Every Time when i go to him to ask for the balance payment he asks me to come next week this is going since last two months. due to non receipt of this payment my employer has held my salary of January and February. I am still working in the company but could not find any way to get the balance payment at the earliest or to get my salary.
is it legal in this matter to hold the salary of an employee if the balance payment of company is not received from any client or delayed from any client.
I am not able to decide what should I do without salary as it has been two months time.
How can i get my salary in this situation.
Please guide me to come out of this situation.

This has been in the practice in some companies to hold marketing people salary for not collecting the payments from customers. But employees will not stay in those companies.
They should at least pay Basic + DA to fulfill their monthly regular expenses. But some companies will hold variable performance pay, bonus and other facilities.
But as per payment of wages act, you are supposed to get salary for the days you have worked. You can raise complaint with your regional labour commissioner. But it may spoil the relationship with your company.
Better is to discuss with them to release atleast half salary for your daily needs. If you decided to quit the company, you can raise a dispute with labour officer.
