Plz. explain how to calculate payment of subsistence allowance. Say Basic is 6300/-, Hra is 3000, Conveyance allowance is 1500. What should be the amt and how it is calculated?

As far as I think It should be 50% separately of all heads mentioned by you.
I am myself not being paid 50% as my employer insurance Co. is deducting all
regular deductions from Gross pay-50%.I have complined to Labour commissioner
who have issued notice.

Dear Animesh sarkar
We calculate Basic+DA+HRA ( HRA as because it is payable as per HRA Act ) for calculation of Subsistence Allowance. Conveyance Allowance is paid for coming to & going from place of employment. In case of suspension ( Pending enquiry ) the employee need not require to come to place of employment & hence the conveyance Allowance is not considered while calculation of Subsistence Allowance. The rate of Subsistence Allowance is=50% of wages for first 90 days of suspension, 75% of wages for next 90 days & 100% of wages for above 180 days of suspension pending enquiry.

If your establishment is one covered by Standing orders Act, you need to pay subsistence allowance at 50% of Basic + HRA + Conveyance allowance( if all the three components of salary are paid to him at the time of suspension) for the first 90 days and 75% of the same for the remaining period of suspension. If standing orders are not applicable to you., the subsistence allowance has to be computed at the rates and on components of wages as prescribed under the terms of your service rules.
