My friend works for one of the reputed financial MNcs.Last month he put down his resignation and currently serving notice period. As per the company policy, after resigning, employee has to serve for 3 months. 1 month is compulsory and 2 month is negotiable.
From the date of resigning till yesterday, there was no communication made to my friend. All of a sudden today morning he received a mail saying, he needs to serve all the 3 months.
This has happened after 23 days of resignation and my friend has committed to join by next moth 1st.
1. How important is to have the NOC and other documents at the time of leaving the company?
2. Can the company blacklist my friend if he leaves on that very day as communicated in resignation mail?
3. At the worst what can happen?

Relieving is required in most of the company, try to negotiate with both the companies, please refer the termination clause and approach the Head HR to resolve the matter amicably. Last but not the least there is not worst to worry about always think positively to sort out the problem, no employer is the enemy of any employee.

The 2nd company is saying that they do not require any relieving letter from the 1st and he can join .Now sir, the question is if he again changes that 2nd company after some years , then will that next company ask for 1st companies relieving letter and if he can't produce that then what will be theire action,Is that will be considered as a negative side.

First of all please share us how many years he have been working in that company?
1 The NOC & Other documents are most important, even most of the reputed companies are expecting the said documents.
2 It depends on management decision
3 The management may deduct the salary of 2 months in his full & final settlement lieu of balance 2 months of services on negotiable basis.
The final simple suggestion is that kindly talk to the head HR & solve the issues with him amicably.

He has served the company close to 2.5 years.
As I mentioned earlier, he was told that the final descion will be taken by the Manager only.
They cannot do anything in this regard.
Let me tell you more about the policy, there were no documents as such that an employee has
to mandatorily serve 1 month and rest of 2 months can be negotiated. He had this information
from his old colleagues who is no more working in the company.

Hi , Do not come out of the company with the documents( relieving documents) as he served 2.5 Years, better to check with bi-out option with current company which might be useful. Regards, Sr HR
