I have left my organization on April 2014 working for 05 years and 03 months,i have received my settlement amount Rs.29000/--only
I suppose that was my last month salary and leave cash balance.
MY QUESTION IS THAT WILL GRATUITY BE PAID SEPERATELY and can I get my EPS money as well?

Yes, Gratuity shall be paid separately by company. You shall get a separate cheque. and a duly stamped receipt for your acknowledgement, in having received gratuity amount. Thanks R K Nair

If the company has gratuity policy taken from any of the companies like LIC then LIC shall give the cheque to the trust created by your company in this regard and the trust in turn will pay the gratuity to you. In case the company has not taken any gratuity policy then the oayment of gratuity.will be made by the company directly. The payment of gratuity is by cheque.

Gratuity payment is legal dues. In accordanac with Gratuity Act 1972 elegible employee shall apply for Gratuity through Form I after processing his case payment to him/her shall be made through Form L. Employer is liable to forward copy of the Form L to office of Commissioner of labour as intimation on payment of Gratuity Dues.

Gratuity shall be paid within thirty days from the date it becomes payable whether with final settlement or separately irrespective of having insurance policy or not.As per sec 7(2) & (3) of the POG Act even if the employee has not given any request the employer shall determine the gratuity and arrange to pay the amount by giving notice to the eligible person and the controlling authority.

Dear Mr.Amit,
You can ask your employer to give you the details of your full and final settlement of your account. Normally, during full and final settlement of services, all the dues shall be included, including wages/salary, Overtime wages, if any, leave encashment subject to availability and gratuityetc but excluding th e Bonus. The disbursement of bonus shall have its own time and when the bonus is declared you will get bonus separately but not gratuity. As a matter of fact, they must pay you gratuity along with other dues. Can you confirm whether you made any application for payment of gratuity to your employer in the prescribed form under Payment of Gratuity Act. If not you apply the same in writing and seek the details of your settlement as received by you.

Yes gratuity can be paid separately, if company is not willing to do so you can put a claim through an application within 15 days as far as EPS amount is concern it can be claimed from EPFo by simply filling form 10C duly attested by employer after 60 days of resigning.

Dear Sir,
1. I'm working in private school in Delhi since March 2010. Initially I was offered a contractual employment of one year duration, with consolidated salary.
2. In 2011 I was put in Probation of one year duration with pay scale similar to Sixth Pay Commission PB-2 with GP 4800.
3. In 2012 I was confirmed in the same scale with annual increment.
4. The school has given me Form 16 since 2010, where the TDS was deducted by a trust which is owned by own school President.
My queries are:
1. Will I be entitled to get gratuity if I leave my job in February 2016?
2. If yes, will the year of contractual employment be considered for gratuity payment?
3. Who will be liable to pay my gratuity? The school which has recruited me according to appointment letter, or the trust which is issuing the Form 16?
