Hi I am working in a Finance company and I have resigned from my job.
As per my offer letter the notice period clause is mentioned as:
\"Your employment can be terminated by you at any time for any reason whatsoever or without assigning any reason, by providing a prior written notice of 1 (one) month to the company.\"
I have resigned on 3rd and served the notice till 19th and i am ready to buy the notice period remaining 14 days.
But my company is not reliving me as they said the notice period policy has been changed to 3 months by the company and they have intimated al, the employees by circulating it through e mail to every body with a link given in the email containing all the policies department wise.
My query is -
1) I have not signed any document for the change of notice period apart from my offer letter. So by only sending an e mail to employee by HR it is compulsory to serve the 3 months notice period?
2) I have resigned on 3rd and served the notice till 19th and i am ready to buy the rest 15 days notice period still do i need to serve the 3 months notice?
3) They are forcing me to either serve the notice or buy it for rest 2 months also , what should i do?
4)And also my reporting is saying that the reliving is not in his hands he cannot do anything , he says i need to speak to HR only for my reliving, my question is If my reporting authority approves the waiver of my notice period do the HR has any right to ask me to serve the notice period?

Since the company had intimated about change in notice period policy and communicated to you all, you may not be able to feign ignorance but to comply. Secondly hierarchy of power between your reporting authority and HR depends on company policy. Thirdly, email communication has now been recognised media of communication. Fourthly payment in lieu of notice period is also prerogative of the company.
Fifthly you need a graceful exit for positive feedback from this employer in case of verification.
It is advisable to have a pleasant exit than conflict. Think and balance all factors.
