Hi Krisna,
Once the Payment of Gratuity Act become applicable to the Establishment, it is the responsibility of employer has to send a "Notice of Opening" in Form A to the appropriate authority, within 30 days.

Dear Krisna,
In case of an establishment If the Payment of Gratuity Act is applicable, you are required to send a "Notice of Opening" in Form A to the concerned labor department under falling your jurisdiction,within 30 days. Besides, you are to maintain a Gratuity Register and also ensure that display "Abstract of Gratuity Act & Rules" is displayed in the notice board of your establishment.

Basic + DA will be taken for Earned Leaves encashment.
Formula is ((Basic + DA) /30)* No. of ELs to be encashed.
Some other points relating to this is:
ELs can be accumulated up to 30 as per Factories Act, 1948, Section - 79.
As per Shops & Establishment accumulation can be done upto 60.
Please note It is better to start a new post if the subject is not related to the existing posting.

Can anyone let me know the solution for the following situation.
The employer registers under the provisions of gratuity, in 2008 (for eg), but has employees from 2003. Kindly let me know.....Will the gratuity calculation be based from the year of registering into gratuity or from the date appointment of the employee.
