i work fabrication ,civil ,& other work as labour contracator, in the big company, now i work some civil works more than 10 employees in munjal autoltc in the waghodiya gidc, vadodara, this gidc cover under esi area, now we apply esi code no in esi offfice, but esi office reject our file because of in a civil work 10 or more employee work on office not in site area, so guide us we cover under esi act or not

Your employees will be coverable under ESI Act only in those factories/units which are already covered under ESI Act and falls in implemented areas. And that too in those projects/units where you undertake repair/maintenance or extension of premises work etc.
In respect of Construction Companies/Firms, perhaps separate code numbers are not been issued by the ESIC.
In case, you make compliance on Code Numbers of principal employers(s), where you undertake work, there is no harm. The main issue is regarding making of compliance under provisions of ESI Act and rules/regulations framed thereunder.
If your firm / establishment is doing work for a number of units, some of which may be in non-implemented areas or not-covered under said Act, you can maintain records of your establishment/unit separately unit-wise and produce the same for verification by the authorities of ESIC or principal employer as and when desired by them.

i have work not only civil work, we work fabrication ,damor road,hdpe pipeline & other work, now i work in wagho diya,gidc, which is coverd in esi covrage area ,& company was insist to us ,to seprate code no ,so we have apply for code no,& my employee more than 10 in waghodiya site work, but esic office says in your company 10 employees in your office, not in site ,but in my office no employees,all the employee work on site,so we confuse

Perhaps, as per facts mentioned by you, your unit neither falls as "factory", nor a "shop" and hence, ESIC has correctly rejected your application for separate ESI Code.

You can inform the employers where you are doing job work(contract work) that you have no separate ESI Code Number and ask them to deduct ESI contributions on the basis of your records and submit the returns of contributions etc.on their ESI Code Number.

In order to qualify as a separate"factory" one must have a certain premises/precincts and also doing some manufacturing work. Similarly, there must be some office premises or precincts and minimum number of employees (ten) in order to qualify for coverage as a "shop".

In case of any confusion, you may visit ESIC website study information available on said site and also go through ESI Act, 1948 and rules/regulations framed thereunder.

The main question is how to make compliance under provisions of said Act. I think, the principle employer will not object if you or principal employer will make compliance on his ESI Code.
