Dear All seniors,

One of our worker have meet with an accident in Bankura (W.B) during his personal visit of that place. He lives in Bokaro. He is covered with ESIC & EPF. But as the accident took place outside the plant, the ESIC manager has rejected to start pension of their Nominee as because there is no any connection between Employee and Employer of his travelling. He suggested that if the employer can prove or submit document which proves that the travelling is belong to his employment then he can start pension to their nominee.

Please suggest what kind of benefit he will get from these act under these circumstances

As his accident took place in Bishnupure railway station also suggest what benifit he will get from railways. This is also informed that the railways master has submitted wrong act on him means he has submmited report where he stated that the accident took place because of negligence of basic rule of railways.

We really want to provide some financial assistance to their family but within the limit of Act

Dear NPMB,
You can not provide any assistance to the family members of deceased within the limit of law, since the death of IP is not due to injury out of employment and in the course of employment.
If at all you wish to provide any assistance to the family members of deceased, you have to provide it out of the limit of law.
My answer is restricted to benefit (pension) under ESI only.

Dear Friend,
ESI authorities are right as the employee was not on duty at the time of accident.
The legal heirs are eligible for funeral benefit from the ESI upto Rs. 10000/-. From PF he is eligible for EDLI , his PF acccumulation, and pension for his spouse and 2 children below the age of 25 years.
As for as from Management concerned, the Management can pay his gratuity upto his superannuation age of 58 years(if Management has obtained a Insurance Policy under the Gratuity act).
