Dear All,
Can you any one clear my doubt, i'm working in contract manpower supply concern.My doubt is "A principal employer need manpower for 30days operation; but i've limited manpower and also the production manager need An X employee for 30days. Any problem will affect in future point of time???

This is more of a business and strategy issue than an HR or a legal issue. You need to assess your potential business, your business plan and your capability to achieve and deliver. If you can deliver X number of people for thirty days and if you can get profit out of the business deal and if you can deliver, then why ask??

Asking or allowing someone to work for 30 days in a month is illegal.
Both under factories act and contract labour act,you are required to gvie 1 weekly off after 6 days of work. Further, no person can work for more than 10 days without a break.
Your company as the main employer and the principal employer both are liable to persecution on this account. Courts and governments take this matter very seriously in case of a complain.
In reality, many people have 30 days working, specially for workers from out of state, who have no social life here and look to make maximum money to send home. But his willingness to do it does not make it legal for you. One complain, and you will be hauled up. Any accident involving them, the fact that they were not given weekly off makes you even more likely to be held liable. The court can give imprisonment of up,to 2 years and a fine of up to 500,000 for repeated offence. (Not sure if anyone had been given such harsh treatment)

Supplying any number of labour for consecutive 30 days or more is a legally accepted business whereas engaging a particular employee without any weekly off, even with his willingness, is violation of provisions of Shops & Estt Act, Factories Act, CLRA Act, Mines Act, etc. attracting penal provisions. Hence, keep away from it.

My friends has rightly pointed out the when you put up a question for clarification, you should clearly spell out the problem giving each bit of facts so that a viable solution is given. Please do not guess what you know is known by others.

Coming to your question of asking a person X to work continuously for 30 days without giving him a break for weekly off is quite inhuman & illegal particularly in the present days when Govt is contemplating to cover the labour in unorganized sector.The other aspect has to be also taken into account is maintenance of one's health. How long person can survive from getting sick if he is asked to work continuously for 30 days in a month.The law provides for weekly day of rest, fixed no. of hours of work in a day,extra wages for overtime work,no. of leaves & holidays etc. By making a person X to work continuously on the plea of limited manpower or because one manager has a fancy for particular worker will not come to your rescue, if a prosecution is filed for violation of provisions of labour laws,which attracts penal provisions consisting of fine was well as imprisonment.
