I am working in a manufacturing firm... i wish to know whether an HR Executive on probationary period is liable to have a PF deduction.

hi mehnir yes from the first day any person joins any establishment as employee the employer is liable to deduct provident fund This law was introduced in late 90s regards

It is nothing to do with designation.
If an organisation is covered, and if an employees salary is Rs 6500 or less per month ( This will not include HRA) he will be covered.
If your establishment is covering employees with more than Rs 6500 pert month salary in PF, then all employees irrespective of salary will be covered from day one.

Once a candidate joins an Organisation, he becomes the employee of the Organisation and he becomes the member of Provided Fund from day one and on the very first day itself Form 2 ( Nomination and Declaration ) is filled up and taken from the employees and while sending the remittance challan copy to the PF office ( has to be sent on or before 15th of the subsequent month of Salary Received ), it has to be handed along with Form 5 and Form 10 which are for newly joined member in PF and employees who have left the service respectively.
So from day one of your joining a Company, you are liable for PF deduction.

If the company is applicable for PF (having 20 or more employees) are compulsary to deduct the PF of the employees from his joining date. If there are below 20 employees & the basic of the employee are above
Rs. 7000/- then he will get exempted from PF. But if the employee's PF is deducted in his previous company, then it is compulsary to deduct his PF in the current company as per the law.

Hello friends,
I am on probation in government of india group 'A' service. Before joining this I was in another govt of india department. I came to this department through proper channel tendering my technical resignation. My new organization is not deducting my contributions towards provident fund.please advise me about the course of action.

It appears there is some mistake in your pay office as once you are member of Govt PF in any organisation and after that where ever you join they have to deduct and deposit the PF in that account. For further clarification lease go through the following act:

Governments of the States concerned hereby makes the following rules, namely:—
1. Short title.—These rules may be called the All India Services (Provident Fund)
Rules, 1955.
This act is available on net and you can download and provide it to your department and they will rectify the mistake.
