Dear All / Team, Pls guide me what should i do as me & my entire team had not received our salaries , conveyance from last three months. I’m mentally depressed & harassed.

Dear friend,
I empathise with you. Working without salary is really very difficult. But then with whom have you spoken about your salary? What you HR says?
If you are convinced that salary cannot be recovered easily then you may approach labour office of your area and submit the application. Let's see what he does.

I would first insist on finding the reason why company has not paid salaries for last 3 months. Many a times, it is all about the commitment to the company during the downfall. And gradually company will pay as they recover.
But if you feel this is not the case, please immediately approach the labour law office and file a complaint.

Thanks for writing.

Company had not cleared the salaries,conveyance & other variables of any employee across india. Few employees had suited police complaint , legal notices against the company but than too nothing moved. We have recieved commitments on mail from the CEO regarding the clearance of same.

He convinced me for the same several times during our verbal convo. till 10th of this running month. Now the problem is that the company had issued our termination letters & are denying to address any satisfactory revert regarding performance when asked.. & promising to pay the entire out standing of last four months as F&F in next 90 days of time to which we strongly disagree b'cos company haven't cleared the F&F till dated for the employees resigned in august.

Many of the employees are going through hard pain & feeling helpless b'cos of probation period.

Company had never kept and followed to the strategies designed by them & changed them at any point of time which itself putted us in a disturbing situation.

Pls help & guide me on few points as below

A) Is this the definition of F&F in a PVT. LTD. Company or as per a law.

B) What can be the other best way out for the recovery of our money b'cos lawyers are charging too much high, They themselves don't have any idea that how much time it will take. I was surprised to see that many such cases are in the court from past 10 - 15 years.

You can file an application under section 15 of Payment of Wages Act, 1936, for any delay in payment of monthly wages only if you are drawing wages up to Rs. 18,000/- per month as per sub-section 6 of section 1- Payment of Wages Act, 1936. This is for the information of the concerned person.

Kindly dont get depressed and kindly analyse the reason for non payment from the angle of management also.Probably you could find an answer.

Heven really will not fall if you dont get salary for months. It is a myth, you assume ur a victim of circumstances. you have been brought up till date not by this company to survive . There are n no of people in your social circle to help, if only u approch them.If you are steadfast in your guts, u will find an alternate job any where. Dont stick to ur rigid assumptions, take a job elsewhere, take a different profession till u come to terms of stability to support urself and family. Many a times we didnt anticpate a situvation like this. and we get depressed . Reality always stare u.

Dont get panic be organised to fight for ur cause collectively, may be action need to be distributed among u people.GET IN TOCH WITH UR FAMILY FRIENDS, SPEAK OUT TO THEM THAT THERE IS A PROBLEM, LET SOME ONE NEAR AND DEAR ONES TAKE ADDITIONAL RESPONSIBILY TILL U TIDE OVER THE CRISIS. ASK THEM TO SUGGEST. AND COMEFORWARD. this is the time u need near and dear ones and family support

While what needs to be done for getting salary has been spoken by several people I want to tell about another aspect. May be that you and your colleagues may have borrowed funds from banks, the banker or their recovery agents will start pressurizing for repayment. This compounds the stress levels in such a situation approach the counselling centres established by banks in each of the districts which are at arms length from the lending banks and get advice. Basically to know to whom to write asking for repayment holiday or postponement of installment or restructuring of debt etc
