Dear All, I want to know your view for the role of HRD on the following points.
1. If Employer/Management put wrong allegation on the employee?
2. If Employer/Management doesn't want to pay PF/Bonus/Gratuity/Salary of the resigned employee?
3. If Employer ask HR Manager to do wrong things?
Is the leaving that organistion only solution?

I must appreciate the questions asked here. This is a dilemma most of the HRs might have faced at some point of time in their careers.

What is really sorry that most of the times they end up being an employee harassment resource rather in the hands of the employer rather than a bridge between the employer and the employees. Cant be really blamed for doing this as that ends up being the only way for them to save their jobs. Listen to the employer or there are other fishes in the pond who can do your job!

Though, its completely unethical to support the employer/ management in the wrong things they do against the employees, the only thing you can do is to try and convince them its doing no good for the organization and will only bring bad publicity to them. And definitely stop them from putting wrong allegations against the employee. I have tried doing the same, and ended up leaving the job coz i could take no more. Choice is always yours.

According to PF act, employer cannot hold the process of pf withdrawl process even if employee has been terminated. Gratuity also needs to be paid after the employee has completed 5 or more years with the organization.

Though payment of bonus is upto the employer whether they want to pay it or not( not sure about this one).

Hello,
Mine is a clear case of Employer harassment of not providing with mandatory certificates etc on the last day of work.Though I had given one month extra notice period still the employer acted in unethical way in not providing with relieving certificate,experience certificate etc.Instead they provided with me a charge letter (I have put my case in Employee settlement & harassment by employer thread)
