Hi,
I have joined a company(MNC) in Bangalore 6 months ago and am still on probation. I was given 3 lakhs as JOining/sign-on bonus after taxes. I am resigning from the company.
The appointment letter says I will have to give back the 3 lakhs in full if I leave the company in 1 year. I am asking for the company to prorate the return of the joining bonus as I have worked for 6 months already and post taxed.
Please advise if this is leagal or in the labor act if I can claim for it.

As there is a contract that clearly stated the terms and conditions and you have also accepted it, it is therefore a legally bind contract. The company has every right to execute as per this contract.
Having said so, it is also no harm to appeal to HR with your suggestion of pro-ration, treating it as an exception.
