Hi, Can anyone help me with miscarriage and tubectomy leave rules as per our law? Thanks Gauri

Hi Gauri,
As per Maternity Benefit Act "In case of miscarriage, a woman shall, on production of such proof as may be prescribed, be entitled to leave with wages at the rate of maternity benefit, for a period of six weeks immediately following the day of her miscarriage.
And
In case of tubectomy operation, a woman shall, on production of such proof as may be prescribed, be entitled to leave with wages at the rate of maternity benefit for a period of two weeks immediately following the day of her tubectomy operation.

Dear Friends,
One doubt on Shweta's reply.. 1) At the rate of Maternity Benefit. What is that ?. Further, Pl. reply whether people working in a Public Limited Co. can also ask for this leave benefit as it is generally not claimed by many.

1) Maternity benefit is the wages paid to a woman employee during the 12 week absence in connection with her pregnanacy.
2) It is applicable to a Pvt.Ltd Company if it comes withi the definition of an establishment under Shops Act.
