Dear Seniors, Please let me know if there is any clause in the labour laws for funeral leaves.If we want to give this leave then how many leaves it should be for IT company? Thanks in advance.

Currently, no any labour laws such as Factory act, industrial employment standing order act, has provision for such leave.
However, under leaves policy, organization prepares casual leave and the purpose is for various uncertain events such as death or any emergency.
While p.l. can be availed for longer time.
For I T company in which i am also working in pune based, we have pl and sl as mentioned above. Employee avail such events leaves from p.l. or sick leaves.
Organization can draft funeral leaves and paternal leaves ( maternal leaves under maternity act).

While deciding the leave policy, you have to fulfil provisions of shops and establishment act of the state where employees work. You can give more number of days than what the act says but not less.
Paternity leave, funeral leave all these are the fringes and it is the prerogative of management to decide the number of days. Be cautious while taking decision, because it will create lot of heartburn if you withdraw this fringe benefit. Secondly, by chance if project manager is unable to spare software developer because of work pressure, how will you handle this situation?

In my view such type of leave is not provided by any of the labour laws.You can send five/six employees of his section alongwith HR officer to attend funeral process considering the employees on duty or in the alternative grant special leave for this purpose.

Hi,
I am not sure why any specifice number of days be marked for Funeral. Birth and death are like ineviatble and happen in a life time of any individual ( only varies , depending on the number of people in the family) and there is no specfic day/s marked. So lets all be humane to this and we do not need any law to govern us.
Organisations do let an employee take leave and in cases i know they have marked this as special leave and exempt from any deductions.

While there are no provisions outlined by any statute, in the wake of the human approach that has taken a prominent idea in the thought of management; organisations of today's world offer flexible leave ideas in such emergency cases. i think the idea of CL is for routine requirements and the idea of EL (emergency Leave) is to accommodate such emergencies like the one outlined here!
I have seen cases where the employee was allowed about two weeks of E. leave as it can affect one's life and family tremendously when a loved one is lost. This was clearly covered in the EL granted according to the terms of employment.
