We have a female employee and she is pregnant.
She is covered in ESIC. She is eligible for 84 days leave.
The Confusion is whether above 84 days will have to pay ESIC or company?
On what terms and conditions company has to paid her 84 days leave???

Hi Shalu,
Maternity leave under the Rule 101 as per Labour Law shall be admissible to provisional female employees continuing in service beyond one year and who are permanant employees.
Maternity Leave shall be of Six weeks before and Six weeks after delivery total applicable period of 12 weeks, if the employee claims less than 6 weeks before delivery, the balance can be claimed after delivery or vice versa. (A total of 90 days).
These 90 days leaves have to be treated as paid leave (i.e salary for the said period needs to be paid to the employee).
The hospital costs need not be borne by the company (that totally depends on the company to bear or not) if under ESIC the employee can avail the benefit under ESIC for maternity cost.
Company is only liable to pay the salary for the 90 days along with the leaves.

Hi Shalu,
An Insured women , who decided to give notice of pergnancy before confinement , shall give such notie in FORM 19 to the appropriate local office by the post or other wise and shall submit , together with such notice a certificate of pergnancy in form 20 for ESIC office.

In respect of ESI covered employees maternity benefit of 84 days salary(not 90 days) will be paid by the ESIC and the employer need not pay anything. Regards, Madhu.T.K

if an insured person’s wife coming to pregnancy then ESIC will pay the insured person’s wife maternity expenses or not?

The insured person's wife will get treatment from the ESI hospital free of cost. If no ESI hospital or ESI listed hospital is available in the area, the insured person can claim hospitalisation expenses from the ESIC.

Maternity Benefit Act 1961, if any female employee has actually worked eighty days in preceding twelve months, before her date of expected delivery. employer shall entitled to the payment of maternity benefit.
Under section 50 of the Act. Every employer shall entitled for payment of maternity benefit, notwithstanding the applicable of the employees' state insurance act.

When that female employee is covered under ESI, the company need not pay any salary to her. She has to produce the delivery report to ESI and get 84 days leave with wage thorough ESI. For these 84 days only LOP from company side.

ESI will pay the 84 days salary (Double the SSB almost full wages). Employer need not to pay anything.
