Hello Everyone, How is gratuity in india calculated in case of death of an employee before 5 years of service and after 5 years of continuous service..Please help! Its urgent! Thanks.

Hi Friend,
Pls note that gratuity is not paid if employee's death before 5 years. If he had work for 5 years and more than it than calculate like.
His current Basic salary/26= 1 day salary , 1 day salary X 15= 15 days salary , 15days salary X number of years he had work.= Gratuity.
Likewise.
Basic=3000
Years work=6 years
than calculate like 3000/26 x 15 x 6= gratuity.!!

Dear madam As per the provisions of the Payment of gratuity act 1972, in case of death of employee, then the minimum service is waived and priests gratuity is payable. Adv SAWANT 9011075672

Dear hetal,
In case of employees death, Continuous service of 5 yrs is not must.
if any employee dies who has served in an organisation for less than 6 month will not be eligible for gratuity.
Any person who has served for more than 6 months or 180 days then the gratuity will be paid for 1 yr.
Similarly if an death employee is served for 2 yrs and 8 months then the gratuity will be calculated for 3 yrs and if he is served for 2.5 yrs he will be paid for 2 yrs only.
Minimum 6 month or 180 days working is compulsory to get the gratuity benefit for complete year for an death employee.
