Dear All,
Please guide me on the following-
My wife is working in a company in Kolkata on Outsourced Payroll and the employer is based at Bangalore and do not have any set up in Kolkata. Her salary is done from B'Lore. Now as she falls under ESI ceiling so she has been given a code by her employer but the code is of Bangalore and dispensary and doctors name everything has been of Bangalore. you can understand that her employer has done all this thing to safeguard the statutory compliance but my wife is unable to avail any medical benefits from ESI.
Moreover due to this problem I am also unable to include my wife under the medical benefits of my company (as spouse) as she is technically already a member of ESI scheme.
Please suggest what we should do?

With the introduction of online system and issue of smart card id cards, the insured is expected to get the benefits from any dispensary he likes. But as most of the local offices and dispensaries are still running without any online system (or even a computer) it is still in its infancy stage. Therefore, you have to collect a copy of the returns submitted by the employer at Bangalore to the local office at Calcutta to ensure that she is covered and ESI has been remitted in respect of her. In the contract system of engagements these kinds of difficulties arise. In the absence of any office of the contractor in Calcutta it is not possible to get a sub code also. Therefore, please ask your spouse to raise it before her employer at Bangalore.

Thanx for the reply.My wife is an IP under ESI benefits but she is unable to get any medical benefits as she is from Kolkata and her ESI code has been generated from Bangalore.
I am serving a Govt. PSU which have some very good medical facilities for self and spouse. Spouse can be included subject to she is not getting any medical benefits from her office. In my case though technically my wife is an insured member of ESI but in practice she is unable to get any benefit from ESI staying at Kolkata. Please suggest the best possible way.
Further as my company provides extraordinary medical benefits for self and spouse so can my wife opt for medical benefits under my company instead of going for ESI benefits by providing any declaration.

Opting out of ESI scheme is not possible but at the same time there is no bar under ESI for an insured to get any other beneficial medical schemes. Even in public sector medical schemes, I doubt if there is any provision that in order get medical benefits the family member should not be receiving medical benefits from other schemes. If not specifically stated,please include your spouse also in your medical scheme. However, your spouse should take it up with the employer immediately and while writing letter mark copies to the Principal employer ( because it is his duty to ensure that the contract employee is getting all statutory benefits and to interfere in case any failure on the part of the contractor to provide it) and the Local office of the ESI.
