A good piece of information but its not the latest. This was on 2/9/11. The latest in this context is the circular date 27/9/11 which has kept the circular dated 23/5/11 in abeyance.

Unfortunately the EPF authorities are not following the decision of the Appellate Tribunal and refer only to Hon'ble High Court decision in Sec 7 A enquiry.They do no refer to or rely on their own Appellate Tribunal decisions even if they are favourable to the Employers like the Indore decision referred to by Mr Sundararaman .This can be rectified only by directions from the Ministry of Labour and Employment, Govt of India as well as the Central Provident Fund Commissioner ,New Delhi.

Dear Rajan,
You can file a legal case against the PF Authority becaz that Circular on 27/9/11 clearly stated "The circular dated 23/5/11 regarding spliting of Minimum wages for epf is abeyance". Every one have to wait till further Notification will come.
No Department is above the Law.

The referred Circular from PF Department itself is enclose for ready reference in case any one do not have copy of same. It has been clearly mentioned that their Circular dated 23rd May 2011 is kept in abeyance.
