I have a question in my mind, can any body give a satisfactory reply of my query please :
In Delhi Minimum wages act says that a graduate's minimum basic pay is more than 8000/- (not exactly) and minimum wages of semiskilled is also not below 6500/- only unskilled are below 6500/- limit, the PF dept. says that the compulsary deduction on basic salary those are below 6500/- basic limit.
in view of above slab no body is eligibel for deduction of PF (except unskilled). Now if a employer will not deduct any PF those basic are above 6500/- then what action can take against the employer.

If any employee’s is continue working in the same origination and already have a PF Account no. than he should eligible for PF, we can’t do exception from PF[/FONT]

Mr.santosh,
if the employee is willing to have pf you can deduct it.it is not mandatory but from the companies pointof view if we deduct the pf it nothing by company is looking after the welfare of the employees sothat when they aleave the company they will get lumpsum amount for their personal use(pf returns).

thanks for reply to Mr. Siva & Modiji, but i am not fully satisfied by your replies. I want to know if one company who is paying salary to its staff not below basic 6500/- for avoiding the PF liablity then why govt not revising the limit. Can any body take any action against these type of companies at present PF act and rules.

Dear santosh,
To adddress this problem recently Dr. G Sanjeeva Reddy , INTUC president and memeber rajya sabha has wrote a letter to prime minister for amendment in the EPF Act and even Bonus Act to include those workmen/ employees who are drawing salary between Rs15000/-to rs.20000/-.
Only amendemnet in the Acts is the solution of ur query!!

Dear Santosh,
According to the provisions of the EPF, every employee (including part-time workers and those employed by or through contractors) shall be entitled to become a member of the Scheme from the date of joining the factory or the other establishment.
However, if the wages drawn is more than Rs. 6500/-, the employee has to intimate his desire to contribute on the whole amount to Employees' Provident Fund Organisation through employer. The employer can also contribute on the whole amount drawn as wages under intimation to Employees' Provident Fund Organisation. BUT, for the eligibility for Family Pension Scheme 1971 purposes, anyone who joins on or after 16-11-95 is compulsorily to join this scheme, provided his/her salary/wage is less than Rs. 6500/- per month at the date of appointment.

Dear Shiva, The minimum wages of Delhi is Basic+DA and in PF is applicable to both Basic & DA. Regarding the EPF limit the Govt is planning to increase the limit from 6500 to 10000.

Thanks to all for communicating and reply each other, specially Mr. Yogesh jalota has posted a good news against my query. Can any body give the copy of the letter of Dr. G Sanjeeva Reddy , INTUC president and memeber rajya sabha submitted before Hon'ble P. M.
Also at present EPF Office can't take any action against these companies who is not deducting EPF of employees whose basic above the prescribed limit. Lets try to implement this law for the welfare of the various employees.

Dear Santosh/All,
Find enclosed herewith the judgement of MP High court in regard to components of Salary for the purpose of PF.
Though PF department yet to sent the notification on this for implementation.

01.04.1983 to 31.08.1985- Rs. 1600.00 (2.4Years)
01.09.1985 to 31.10.1990- Rs. 2500.00 (5 years)
01.11.1990 to 30.09.1994- Rs. 3500.00 (3.10 Years)
01.10.1994 to 31.05.2001- Rs. 5000.00 (6.7 Years)
01.06.2001 to on words - Rs. 6500.00 ( 10 Years)
