My query is, if is person worked in an organisation for 4 months and he died on job within the officed premises. wht all compensation his family can get. he was 52yrs old. and his PF was not deducted from his salary but he was member of PF for last 25+ yrs.Re 1 was deducted for 4 months as employee welfare fund. also his PF amount in his previous employed organisation is still lying in his PF Account.
My query is, if his family is eligible for PF Pension or gratuity or any other compensation. wht all steps his family should take.

he will get PF amount and Pension. If your organization under ESIC or Under Workmen Compensation, employee will get funeral expense and other benefit. he will also get benefit from Labor welfare Department. as well as company will give compensation.

His wife will get PF, EDLI and pension from the RPFC. She has to get legal heir certificate and to apply in the following forms for the claims under EPF Act in RPFC.
Form 5 (IF) - EDLI
Form 10D - Pension
Form 20 - PF Withdrawal
Shall enclosed address proof, ID proof, Cancelled cheque along with those applications.
Gratuity may not be applicable as he has not completed 240 days but can pay for one year by considering that he has worked for one year.

Transfer of PF has to be done from company to company as a first instance. All the forms shall be submitted with the RPFC and RPFC will take care of the rest. Regards, V Ravisankar

first apply for EPF pnly not for EPS because of he is having more than 10 yrs of experience so he is eligible for EPS if we can claim the EPS certificate's from RPFC and we can submit thise certificates in the previous company where he worked and that company is where registered with thr RPFC he will get easily Pension i.e., his family members. he is eligable to get Gratuity from your company and other benefits from if he is coming under ESIC then there also he will get benefits.

I my opinion, since the deceased was not admitted to PF by the second employer, no PF benefits are entitled for this period of four months. However, his PF membership for 25+ years duration will certain help his wife and two children below 25 years of age, get pension under EPS 1995, Deposit Linked Insurance benefits and return of PF accumulations with interest till the date of payment. This claim is to be lodged through the former employer and the second one. Has the first employer paid gratuity ? The second employer may grant him benefits under welfare scheme, other benevolent schemes etc.
