One employee working in our company since last 4.3 year and he has resigned yesterday asking him to relieve on 16th June-11. But as per the company policy he has to serve the notice period of 2 months and even company side its not possible to relieve him before 2 months. Even we dont want to give him the option of buying notice period as we need him for 2 mnths though option of buying notice period is mentioned in our appointment letter.
So in case if he goes absconding after 16th then what all the actions we can take against him.

In such cases dont accept reisgnation send him notice to join duty immediately failing which you can recover notice period amount or amount you consider to recover from him in event of his non perfomance of notice period considering as loss , can be recoeved through civil suit.

As per provision of your company employee must need to serve notice period of 2 months. If he/she has requested to his supervisor/ concern authority for relieve him/her without serving notice period. If his application get accepted then he/she may quit the organisation without serving notice, otherwise he must have to serve the notice period for taking the relieving letter, claim etc from the quitting organisation. If he/she doesn't serve the prescribe notice period the employee shall not relieve him/her properly, which may cause trouble for his future career endeavor.
