In one particular company whose office is situated in city commercial area and is covered by Shop and Establishment Act. For marking attendace a registered is maintained where all the employees mark their attendance. The company has moved to biometric system of marking attendance. And a deviced is installed where all employees are supposed to mark their attendace. Now is it necessary for employees to mark attendance both on biometric device as well as registere? Is always necessary to have manual registers for marking attendance?The answer to this question may be given after giving due regard to applicability of relevant provisions of the applicable Acts such as PF Act and Industrial Dispute Act etc.

You can not expect an answer with reference to legal provisions or as per section .... of ID Act or Payment of Wages Act or like because as per these Acts manual registers are mandatory. If you go through various Acts, there will be muster rolls in each Act. But practically, we maintain only one register and that is accepted also. In the similar way, you can have biometric system. When you computerise your wage register, wage slip etc, you have to obtain permission from the Labour Department after submitting hard copies of the returns, registers etc and the permission is granted only if the relevant information as are required in various forms under Labour Acts are available in the system generated forms developed by you. In the similar way also, you have to get permission for introducing biometric system of attendance marking. Once permission is obtained, you can follow that in the place of manual register.

Your biometric device connected with d attendance software provide what kind of facilities...if it provides report generation then no.
No it not necessary to maintain register if you are using Biometric system..your system should generate each & every kind of report on daily,weekly , monthly basis...But the HRM who is handling the software should be very regular & friendly with the software..& as well as PF act & Industrial Acts are concernt the monthly report so generatd cn be shown....
