Hi,
Can employer take legal action again employee if he leaves the job by resigning but not serving proper notice period say3 months.can he be sued by co. for recovery of notice period.what all legal implications will be there.
Also if co. by mistake even after resigning,keeps on crediting the salary in employees a/c for2-3 months,is the employee legally liable to get sued.

Employer can sue employee for compensation for breach of contract. If in appointment letter in exit clause notice period or salary in lieu clause is there employer can file suit against employee for compensation.
Employee getting any benefits(salary without work) by mistake of employer/employee then employee must pay all money(salary) bacl to employee to avoid any issue. Employer have every right to get his money back. Provision related to this is given in Indian contract Act 1872.
