My company given 21 days as Earned Leave + 7 days as CL which is clubbed together as 28 days and 7 days SL in a year. Leave is considered as Calendar year i.e. Jan-Dec. If a person has joined in the month of February'11 and have availed leave in the same month for 3days,in the month of march for 1 day as sl,in the month of april for 1 day as Pl and now again in this month i.e. may for 2 days.
According to our company's rule we do provide leave on pro-rata basis in case of emergency before confirmation. Now please advice whether it should be considered as LWP.

as the employee has joined recently he can avail the benifits of EL however he can avail the bebefits of SL & CL but these leaves are for an year so u can count as two days leve a month and can consider the other leaves as LWP

Leaves can be sanctioned on pro-rata basis. Be flexible towards employees. They had to go on leave on inevitable circumstances. If they availed more than the eligibility accrued out of pro-rata calculation, then those leave period may be treated as LWP.
