Dear mishraprakash87, You can refer to paymen of Gratuity Act it does not state that 5 years of service if emp work for 4 years and 240 days then also he is laible for Gratuity as per act.

Hi,
Can anybody help me regarding Gratuity?
I am working in ISO standard BPO from 2005-till date.
And i will resign on 31 March 2011.
On first year ie from Oct 2005 to Oct 2006 , i m not directly payroll of my company (probation Period) and on Oct 2006 to till date I am on payroll of company.
I have completed total 5 1/2 yrs. so my question is shall i able for Gratuity or not?
I have asked my company they told me that u r not applicable as on period of oct 2005 to oct 2006 i am not on payroll of company.
Please help me regarding this topic ASAP.

The question arises, who has allowed exemption to the company from paying gratuity against the provisions of the payment of gratuity act?

There is an amendment took place in gratuity act in 24th may 2010 that the gratuity ceiling and exemption both has been raised up to 10 Lac from 3.5 are both the conditions true or partialy true pls. share

Exemption from application of Payment of Gratuity Act is conditional.The establishment seeking exemption should have a scheme providing gratuity and pensionary benefits which are not less favourable than what is provided in the Act. Rules of the Scheme should not be in conflict with the provisions and Rules framed under the PG Act
