I need some information regarding INTER STATE MIGRANTS ACT
i) when its applicable to an industry?
ii) what are all d legal implications if it s applicable to an industry?
iii) what r all d statutory registers to be follwed if it s applicable?
iv) whether any approval should be get before engaging labours from other state?
& other details regard this act

If Contractor plan to recruit any worker(s) form the state other then the the state of location of the Project/favctory of company where it is located, then he shall obtain a licence rule 7(1) of the rules made there under INMW Act from the approriate licenceing authority of the state from where he plans to recruit workers and also necessary Licence under rule7(B) from licencsing authority of the state where the Project/factory of the company is located.

He shall in such cases pay journey allowance to all such workers for their travel from their home twon to place of work & back and wages During the period of such journy.

The Contracor shall pay Deployed allowance equivalent to 50% of his monthly wages /75-RS Whicher is higer at the time of recruitment of worker

The contrctor shall issue a pass book to everymigrent workmen as prescribed under the act.

The conrctor shall furnish complite datials in respect of migrent workmern in Form:X

Monthly return Form:XI

Emploment of workmen: XIII

Displacement & Outward journey allowance sheet Form:XV

Return journey allowance Register Form:XVI

We have one MNC whose head office is in west bangal and they have deputed 10 persons in my unit situated at Rajasthan, whether ISMWC will be applicable on these 10 persons.

Kindly Send abstract of Contact labour act 1970, Minimum wages act 1948, Payment of wages 1936, Building and other construction work (RE & CS) act 1996, The inter state migrant workman (RE & CS) act 1979, employee provident fund act 1952, and payment of Bonus 1972 in hindi as well as english for display in notice board.
