Can anyone help me in the below questions on Gratuity.
1.Is there any salary slab for those who are eligible for Gratuity, or all employees who completed 5 years are eligible ?
2. Any cut off amount for Basic and DA in calculating Gratuity ?

From India, Mumbai
Dear Member,
In my opinion there is no specific mention of slab for the employees to have gratuity from the employer. Every employee is entitled to receive gratuity from the employer with whatever may be the slab or salary or wage pm.
The P G Act, 1972 do not have any provision on any cut off amount for Basic and DA for calculating Gratuity.

Dear Sajit,
Nowadays there is no salary ceiling for Gratuity. The ceiling of Rs. 10,00,000 is applicable on total amount. That too for statutory claim and income tax exemption. As per section 4(5) of the Payment of Gratuity Act, employer can pay in excess of the ceiling limit.

No salary limit for the eligibility. But the eligible maximum is limited to 10,00000/- Vijayarajan.

The above limit of Rs. 10,00,000 is for statutory claim only. i.e The employee is having a statutory claim upto an amount of Rs. 10,00,000. But as I posted above, the section 4(5) of the Payment of Gratuity Act 1972 stipulate that the employer can pay in excess of Rs. 10,00,000.
