Hi vijay,
ESI is contributed from both the sides Employee as well as Employer.
It is been calculated on the basis of Gross salary per month and the maximum ceiling is 10000 Rs./Month.
The contribution from both the sides is as below-
Employee Side- 1.75% of gross/month
So if gross of an employee is 8000/month then
ESI contribution would be 8000*1.75% = 140 Rupees
Employer side- 4.75% of gross/month
ESI contribution would be 8000*4.75% = 380 Rupees.

That means company share is higher...so what company does that if some employee's salary is fixed as 9900 or something..then they make it 10010/- so that employee will be exempted from ESIC...! which inturn beneficial for company..
Secondly, Insured Person (Employee) can not include his/her brothers & sisters in taking benefits..There is specific Definition of "Family"...
One has to submit Declaration form No - 1 along with form No - 3 at Local ESIC office with Sub Code.....Please note that Male & Female Employees forms should be submitted separately...
Kindly come up with some specific query on the same so that it could be answered..

Hi Vijay,
Yes it is same in both the companies, there is no any separate Act related with IT company specially for ESI or PF. As these are the statutary Acts and it applied similar in every industry.

Contact the ESIC Office in your state if u are planning to introduce ESIC. - Min 20 employees in the org - Sal less than 10000 - See if there is ESIC in your area or if it can be covered. Rgs, sweta
