Employee Absconding and Legal Action: Understanding Notice Period and Dues Recovery - CiteHR

Hi, I worked for an MNC company, but due to some reasons, I left that company without informing my management. I received letters from the company stating my termination of duties from the organization. At the time of joining, the joining letter mentioned that if I quit the job, I need to serve a notice period of one month or pay one month's gross salary. However, I was not in a position to pay, and that is why I didn't respond to their letters. Recently, I received a letter from an advocate agency ordering me to pay the dues with interest. They also mentioned that if not paid within the specified time, legal proceedings will be started against me. I just want to know if any action can be taken against me or if they are just recovery agents collecting the amount on behalf of the company.

You have not mentioned what country you were working in. Was it India or some other country? From the write-up that you have given, it appears that you have abandoned your duties and did not resign from the post. As far as India is concerned, an employee who abandons his/her duties, nothing can be done against him/her or at least I did not find any employer taking any legal action against an employee who abandoned his/her duties. You need to check the prevailing labor laws of the country.
