A few questions here, which I wish to be replied:
1.When will the Gratuity Act (Amendment )2010, as approved by the Cabinet take effect?
2.Will the employees under the states and the state- owned PSUs be benefited by this proposed amendment of raising the cap from 3.5 lakhs to 10 lakhs ?( Do the states need separate legislations on this line?)
3. What is the extent of retrospective effect?
4. Here is an employee who has retired on 31-03-2010 afternoon, and who has been paid according to the rules of payment of gratuity as existed on my date of retirement.
Can I make a claim for the balance amount depending on the retrospective application, as and when the amendment comes in force?

1) The act came into effect from 24th May, 2010
2) Amendment pertaining to increase in ceiling to Rs.10.00 lakhs to State Government employees & PSU in already in force.
3) As told above effective date is 24th May, 2010
4) In this case, no more additional payment is required to be made
