Can anyone help me in the following issue:
I am working in Construction Company. Wherever we get a contract to construct buildings, the principal Employer has to pay the CESS to the Government as per Building and Other Construction Act. Since the principal employer is paying CESS, ESI is applicable or not? If not, is it applicable to all the workers (Principle employer, Contractor, Sub-contractors etc). Also please let me know how the workers can get the benefit from this Building and Other Construction Act.

Subject- Applicability of BOCW Act/rules
For therrmal Power plant -during construction phase whose site Site plot and building plans have been approved under The Factories Act, whether BOCW act will still be applicable ? or will come under purview of the Factories rules itself.
