My Co. is planning to revise leave policy by amending it in a way that now onward if any employee (confirmed) wants to avail leaves in one go he/she can not as now onward Co. will keep their 30 leaves.Employee can avail leave on prorata bases only.
Pls. advise.

Dear Tripti,
First examine which the Act is applicable to your establishment for grant of earned leaves & thereafter go through provisions relating to eligibility, grant & accumulation of earned leaves before changing your leave policy. At the same time if your unit is covered under the Industrial Disputes Act, 1947 then also go through section 9A for effecting such change.

Our co. is software Co. n is under Shop and estabilishment act.
the reason behind the new leave policy is as most of the employees are leaving after getting their increment due to the current market status .

Dear Tripti,
If your employees are leaving your establishment then it means you are not paying at par with the market. There may be other reasons also.If you are covered under Punjab Shops & Commercial Establishment Act, 1958 as applicable to the State of Haryana then go through section 14 on 'Leaves' for your query.Do not make such policies which are contrary to law.

You are right mr. Khola..But we are also paying very good package..but few employees have developed this practice..means getting good increment and leaving the Co.

Company can keep the permitted E.L.s of the employees in its account from leave encashment. But it can not deny from going on leave on the ground of reserve.
