Hello Friends,
If anyone help me in deciding whether under the minimum wages act, the wages fixed for a day is inclusive of wages of weekly off? That means, whether in a month of 30 days, wages to be paid is wage rate X 30 (or) wage rate x no. of days worked?
Kindly clarify?

Dear Member,
It is hereby clarified that if the appropriate Govt. have declared daily rate of wages then it means that it is inclusive of weekly off day payment as we make calculation of daily wages by dividing the monthly rates of wages by 26.In this way we are to grant weekly off day to the daily rated employee but we are not to make the payment that weekly off day. Therefore in case of daily wagers we are to multiply the rate by the total no. of actual working days of the month for calculating his wages for that particular month. Hope this clarifies your query.

To understand the explanation that you have provided, please find the example given below.
i.e For Example in Gujrat the minimum wages is 4339 per month hence the the daily wages would be 4339/ 26 i.e Rs 166.88
And if the employee has worked for the entire month i.e all 26 days hence total wage would be 166.88 * 30 i.e Rs.5006.53
Kindly clarify if this is OK.

If employee is working as regular employee & getting salary/wages on monthly basis the formula of calculation of Salary / wages will be salary rate / 30*pay days or salary rate/ month day*pay days or salary rate / 26*pay days please clear the calculation method of monthly rate employees salary with support of legal presence i.e. reference of any Act or any court judgment etc.

This is to inform you that my area of working is Haryana State & as per Haryana Govt.latest minimum rates of wages notification dated 27th June, 2007 it has been specifically mentioned at the note part that ‘while calculating the per day wages the monthly wages shall be divided by 26 but for deduction, if any, shall be calculated monthly wages divided by 30 days’. Therefore, what other States Rules/notifications are following the procedures regarding calculation of one day wages under the Minimum wages Act /Rules can not be described. In my opinion monthly wages means wages for 30 days as month means 30 days. It is also not specifically mentioned in any of the Act that we are to divide the monthly wages by the no. of days of the particular calendar month for calculating one day wages.

sir,
e For Example in karnataka the minimum wages is 5566 per month hence the the daily wages would be 5566.20/ 26 i.e Rs 214.10
And if the employee has worked for the entire month i.e all 26 days hence total wage would be 214.10 * 30 i.e Rs.6422
5566/30 = 185.5 * no of working days(including sunday) or 5566/26 =214* no of working days (excluding sunday)
Kindly clarify if this is OK.
