I would like to know the legal proceedings of employing a foreigner in India and also the formalities that I need to do if the foreigner is already working in India.
Please let me know the legal formalities, the process and the expenses I need to make.

A foreigner can be employed in India provided he possesses a valid work Visa.
A foreigner is also covered by EPF, the details of which are available in the website of Employees Provident Fund Organisation. There are sufficient number of postings in this forum also in this regard.

Hi,
Firstly it becomes necessary to check if there is any agreement in between India and the country from where the employee is coming, and whether there are any terms decided by the countries to employ each other's citizens.
Recently the central govt has passed one resolution regarding payment of PF Contribution with regard to foreign employees in India. As per that the PF contribution of foreign employees is to be deposited with PF authorities in India but while disbursing the PF amount to such employee after his termination etc. decision is to be taken as per the provisions of the International agreement with his country.
