The origin of the gratuity concept and reasons for enacting the Payment of Gratuity Act 1972. Is gratuity payable in the case of compulsory retirement of an employee? If payable, what are the reasons, rationale, and logic thereof.

Dear Bhatt,

In case the particular employee finished his contract according to the HR policies, then we can pay his gratuity from his date of joining (DOJ) till his last working date, excluding his emergency and vacation leave.

Hi,

Point A: Not possible unless the employee has completed 4 years and 240 days of continuous service, or unless he meets with an accident that results in permanent disability preventing him from working, or in the unfortunate event of the employee's passing. Even in the case of a contract not being renewed, Point A still needs to be satisfied.
