Applicability of Labour Legislations to Educational Institutes: Insights on Minimum Wages, Gratuity, - CiteHR

Dear SiteHR Seniors,

I am associated with a group of Educational Institutes offering education to graduate and postgraduate students through different colleges, academies, and institutes. There are different institutes and colleges working under the umbrella of a main Public Trust. All institutes and the trust employ many employees under broader categories of teaching staff, non-teaching staff, managerial staff, administrative staff, supervisors, assistants, clerks, peons, housekeeping, and maintenance staff, etc.

My query is about whether the below-mentioned legislations are applicable to the educational trust and educational institutes detailed above:

1. Minimum Wages Act
2. Payment of Gratuity Act
3. Shops & Establishment Act
4. Provident Fund Act
5. Profession Tax Act

Please respond.

Thanks & Regards

Education has already been declared as an industry by the Apex Court. Therefore, all the enactments concerning labor that you have mentioned are applicable to the people employed therein.
