1)Due to some personal reasons i doesnt have a smoth exit from my previous company (Without relieving letter)
2)Also i was worked only 10 days in my notice period
I have joined in my new company a week before.
if i try to opt for PF transfer or PF withdrwal it goes to my previous employer for verfication and autorisation.
In my case, i havent satisfied the norms of previous employer. Will it be possible to claim my PF amount in any other way.
I herd that employer can hold the PF account is it true.
please throw your valuble suggestions to get my PF amount.

They cannot hold your PF withdrawl or transfer. PF contribution is statutory which is monitored and controlled by govt. In case your previous employer creates a problem for you in claiming your PF then you can file a complaint against them in Regional PF Commissioner's office for that zone.

Hi This is Bhaskar,
Your previous employer cannot hold your pf dues to settle.
But has all the rights to hold your final settlement, where pf is a part of your final settlement.
Bur my suggestion to this is please speak to your previous manager convince and send him a pf withdrawal form (Form 19 and 10 C), if you want to transfer the same to your present company then send Form 13 (should be routed thru the present employer) marking cc to respective RPFC, which can help in to get your pf amount.
PF authorities always to support employees.

Dear GOK,
Bhaskar's advise is best. And if F-13 has already been submitted, you can approach the PF Enforcement Officer or the RPFC concerned and seek solution. Generally when the employer refuses to forward form-13 or F-19, it can be frowarded through the district Tehsildar along with a verification from Patwari.
In no case can the PF amont be witheld by anybody, if it has been deposited (You must have PF Account No.)

I too agree with Bhaskar's advise. Nobody can stop your PF amount. Also if you have good relation with someone senior in the organization you can try to get the relieving/experience letter.Talk to senior management and tell them that you had a great learning experience and respect the organization. And would like to leave the company on a good note........... I always ensure that when if I leaving an organization due to personal or professional reason I exist on a good note and complete all the formalities. Cause the current employer will always verify your past employment history thru external/outsourced channel.................best wishes

No one can hold your PF amount if you have resgined. Bhaskar has given a right suggestion. But you'll have to resign first. You should have resgination acceptance in case if you are not having any releaving or experience letter to go for any statuary action.
