you can file a case in district consumer forum and you can make party to PF authorities as well as to company.
i feel you talk to them or wite a complaint to RPFC and send copy of complaint to central provident fund commissioner.state the complete story.i think your purpose will be solved by this.filing of case should be last option.
you can take telephone no from their site www.epfoindia.com

Hi,
When ever PF form is rejected , pf dept sends back the form along with the letter mentioning the reason of rejection. So check the same with your previous company and get it rectified. your problem will get solved instead of going for a case against the company and pF dept.

Harshad

Like what our Malik sir said, you can file a case in CPA. since PF is having regulator and facilator role, you can contact the central PF commissioner also

Yes, I agree with Sh.Malik. You need to first find out the exact reason for rejection. He needs to check with his previous employer by writing to them and keep copy of the letter and the courier slip. This can act as a proof when you eventually file for a complaint. Alternatively also check with the EPF officials for the reason. I'm sure they will help him out. I am saying this, because I too faced a similar problem recently, and it was from the EPF office that I got the entire details of my transfer, which even my current employer was not able to furnish.
He needs to gather all the above informations to file a case which should be the last resort.

Hi Kavina,
We are agreed with HTDesai. PF Department while rejecting the Form 19 or 10 C gives the suitable reasons for the rejection.
Reason may be the:
1. Mismatch of the data filled in form 19/10C and the form 2 submitted earlier by the company.
2. contribution not matches with the period worked by the employee.
3. Correction in the form.
4. Claim already withdrawn.
5. any many other technical reasons.
In the discussed situaton, reasons for the rejection must be clear and accordingly action can be taken.
Ask to the HR of your previous company to surrender the receipt of the filing the application in the EPFO and put up again the application to EPFO along with the appropriate representation. This receipt will help you to enquire the status of your Form 19/10C.
Without finding the reasons, filing the case is not the right way. EPFO may be a party, where it is surely established that the sum has been deposited with EPFO under a suitable PF no; therefore in case you are intended to file a case in which the EPFO is a party, make sure that facts are really true and reasons to make EPFO a party.
