This Checklist was prepared by me when I was working in Mumbai. This Checklist is as per Maharashtra Shops & Establishment Act. Please do recheck the Sections and if there is any change let me know.
1.Whether falling in the definition of establishment Under Sec. 2(8)?
2.If yes, whether registration under Sec. 7(1) obtained?
3.Whether any change in the particulars supplied at the time of registration is being communicated to the Inspector ?( Sec.8)
4.Whether the opening hours, closing hours, interval for rest, weekly holiday are in accordance with & in compliance with provisions of Chapter III of the Act?
5.Whether the employment of children, young persons women, if any, is being made in accordance with the provisions of Chapter VI?
6.Whether provisions of leave & payment of wages are in accordance with Chapter VII?
7.Whether provisions of health & safety are in accordance with Chapter VIII?
8.Whether registers & records are being maintained in the appropriate form in accordance with Sec. 62, Rule 20 of The Maharashtra Shops & Establishments Rules, 1961?
9.Whether wages for overtime work are being paid in accordance with Sec. 63?
10.Whether notice of termination of service of an employee who has been in continuous employment in compliance with Sec.66?
NOW BIG QUESTION IS IF YOUR COMPANY IS IT/BPO, HOW YOU ARE MAINATAING THE RECORDS???? WHETHER THROUGH SOFTWARE OR MANNUAL??? IF SOFTWARE MAINATENANCE, HAVE YOU TAKEN EXEMPTION FROM LABOUR DEPT???? IF NOT, WHY????
IF YOU MAINTAIN MANUALLY, DO YOU FEEL ANY PROBLEM WHERE AS YOUR COMPANY IS SOFTWARE COMPANY?????
