Dear Fellow members,
Can u pl. clarify that whether the National Holiday which fall on Sunday can be compensated by announcing one more Festival holiday? Is it must? (i.e min.9 holidays)
My collegue argues the N-hoilday cann't be compensated irrespective of the Day it falls. It has to announced to observe that day by the workmen.
He adds, in case if all the 4 N-holidays fall on Sunday, then we can very well announce only 5 f-holidays.
Can u pl. clarify?

Hi Srinivasan,
As per National and Festival Holidays Act, you cannot substitute a National Holiday with Festival Holiday even it falls on a Sunday. But you can substitute a Festival Holiday with another Festival Holiday. You may please go through this particular Act for further details.

This is Jeyaseelan working as officer HR in Chennai.
As per the NF act we need not compensate the holiday.
But normally companies are not practising this.They will compensate the day with another working day.This is only because to build a good will among the human resources.
Any thing over and above statutory will definitely bring us up.

Hi,
As per act company should give 4 National Holidays and 5 festival holidays compulsary. If National holiday come on sunday no need to compensate. But, company have to give any 5 festival holidays compulsary. Festival holiday only should not fall in Sunday.

Can you please elaborate or provide supporting evidences from the act to state why we need not pay wages for Aug 15 as it fell on Sunday. Your reply will be highly helpful to throw ligh in to this topic

If possible then clear the n.H and F.H., it complesary to the company to give a 4 NH and 5FH as per Act.
In Act any specification about the NH and FH, If yes then which Act and In which Section it mension.....

Dear Srinivas,
No substitute holiday (off) is given inf any of the festival holidays initially declared subsequently happens to fall on a weekly off or any other nonworking day or in the event of more than one festivals falling on the same day. As per the central Govt holiday Policy.

It is NOT MUST to give compensatory holiday for the NH that fell/falls on sunday. It purely mangament discretion.
Careful reading of N & F holiday Act says that 4 NH shall be declared on the dates mentioned & no other conditions. Similary principle for Festival Holiday. Here its de management has decide days & dates in consulation with union/worker's representative.

The Number of holidays differs in different states. There is no replacement for national holidays and it should be given mandatorily even if it falls on Sundays, but in case of festival holidays we can replace the holiday that comes on a Sunday with another one that comes on any other day.
