I think anyone having gross salary less 10000/- Rs. pm is covered in ESI act what so ever may be the nature of the job.
Employees eneaged in road construction must be covered as they are more likely to accidents.

Construction Companies who engage workers at sites not being on a regular basis are not covered under the ESI. At the same time, where the company has 20 regular employees (drawing not more than Rs 10000) in its Office like Draughtsman, Foreman, Supervisor etc they will be covered. If the office staff number 10 and they employ 10 for the site who do not sign the daily attendance register and wages register, then the company is not covered. However, if the construction company employs 20 or more workers on regular basis that these workers will be deputed at the company's various sites, such company will be covered by ESI. The test of regularity is the signing of muster roll.
