Legal Requirements for a New Factory in Pune: Do We Need to Register Under the Factory Act? - CiteHR

Dear all,

We have opened a new manufacturing unit in Pune. Currently, there are 8 workers and 7 staff members working in this unit. Is it compulsory for us to register under the Factory Act or any other relevant act? What are the legal compliances required for this unit?

PF and ESI are applicable because there are more than 10 members. What other regulations are necessary?

Dear,

As per the law, if you have more than 10 workers working with the aid of power or 20 workers working without power, now in your case, 15 staff might be working with power, so you should be registered under the Factories Act.

Please let me clarify that whether you call them staff, office workers, or managers, as per the Factories Act, all should be counted in the workforce. Please do not consider other acts where the position differs in defining workmen and staff. For registration purposes, even security personnel should be counted. Except for the Provident Fund (PF), all laws related to labor are applicable to your factory, such as the Employee State Insurance (ESI), gratuity, bonus, payment of wages, minimum wages, etc.

The applicability of PF will soon include 10 personnel, though there has been no notification yet.
