Hi, Maternity leave will be granted to a woman employee on production of Doctor’s Certificate as proof of her pregnancy provided she has put in a minimum of 80 days service in the 12 months immediately preceding the expected date of her delivery. The employee will be entitled to Maternity leave with full pay up to 12 weeks, 6 weeks before delivery and 6 weeks after delivery up to 2 confinements only. The applicant for Maternity leave shall give notice to the Company of her confinement not less than 8 weeks in advance. In case of miscarriage or medical termination of pregnancy, the employee concerned shall, on production of such proof as may be prescribed, be entitled to leave with wages at the rate of maternity benefit, for a period of 6 weeks immediately following the day of her miscarriage or her medical termination of pregnancy, as the case may be. An employee suffering from illness arising out of pregnancy, delivery, premature birth, still birth or miscarriage will be entitled for further leave, against her Privilege Leave entitlement, and depending on requirement, for additional leave of a maximum of one month without pay. The additional leave will be granted based on the Company doctor’s recommendation. Maternity leave is not encashable in any manner. Employees covered under ESIC are not eligible for the above benefits.

Yes it is a paid leave. An extension of leave in case of Maternity will be either on the balance of PLs available to the credit of the employee or on LWP.

Hi, Maternity leave is a paid leave, After the amendment by the parliament don't worry about the pre-natal leaves and post natal leaves. Take it as 12 weeks of Maternity leave and not as 3 months of leave. It doesn't matter he or she is directly or contract employee. If you are the prinicipal employer the liability lies on you.
