Dear Kamal,

Salary/wage is not a determinative factor for the applicability of the Employees Compensation Act,1923 to an employee but only the nature of his job. Unless it is known, one cannot answer the query like the one you raised.

The Workman Compensation Act (now called Employee Compensation Act) will apply to everyone who is not under ESIC.
So if your employee is under ESIC the act does not apply, otherwise, it is applicable.

But it would be helpful if you gave all relevant details instead of being cryptic

As pointed out by Umakanthan Sir, for applicability of Workmen's/ Employees Compensation Act, wages is not a criterion. But in respect of an employee who is covered by ESI Act the compensation payable as per the Employees Compensation act will be met by the Corporation. Obviously, an employee of an establishment covered by ESI Act whose salary is less than Rs 21000, would be under ESI and hence if any thing happens to him, the ESI Corporation will meet the compensation payable and the employer need not pay it out of his working capital.

I agree with Banerjee sir. When some one is putting a query for clarification need to give full details so that they can get effective response, which in turn will be helpful to others.
In the query the employee is drawing under Rs.21,000/- means definitely the querist shall mention whether his organization is covered under ESI or not. This will enable to provide an appropriate and elaborate answer.

Requesting all querists to make a note of the same to derive larger benefits from this forum and thereby benefit other enthusiasts.
