Dear Professionals,
Due to production requirement, we have decided to transfer some of our employees to our company located in Shimoga. But they refuse to go to Shimoga, even the management assures them salary increase and other allowance. It was clearly stated in their appointment order that they are liable to be transferred any where in India on need basis. After several discussions with them, they settled with resigning their job with some amount of settlement.
In this situation, the management prefers to settle them statutorily. Here, I seek your professional advise whether shall we go for retrenchment compensation (as they deny to go on transfer), if no please suggest me what compensation can be given to them.

Dear Mr Madhan
In view of the specific transfer condition in the appointment order, pl inform them that in case of refusal to go and work in Shimoga, they will be treated as absent from duty and appropriate disc action will be taken which may lead to dismissal from service. After some time they will come with a request for some compensation and you may ask them to submit their resignation and try to settle with some extra amount which has to be less than the retrenchment compensation.
