regarding higher pension as per recent Hon'ble Supreme Court decision. I request you to please give suggestion for proceeding.

1. I contributed PF from 01 10 1989.
2. My plant was closed in April 2014 and paid PF contribution upto 30-09-2013
3. Pf authorities given date of exist 30 09 2013
4. Superannuation date 30 09 2013
5. my date of birth is 21-01-1958 and completed 58 years by 21-01-2016.
6. Pension commencement on Rs. 6500/- from 21-01-2016 and receiving Rs. 2275/-since 21-01-2016
7. I have not given option to the PF to deduct from total basic and DA.
8. Employer deducted Provident fund on total basic and DA and pension contribution deducted on Rs. 6500/- only.
9. pl advise me how to proceed further in this regard to get higher pension.

Since you have exited from PF membership on 30.09.2013 and there is no mentioning of joint declaration by you under erstwhile para 11(3) and Para 11(4) available either with you or your employer, presuming that either you or your employer is holding such valid joint declaration and in that case EPFO has allowed to apply before 3rd March 2023 for higher pension that too only through online link provided by them in their member portal and that link is also now removed by EPFO. As of now there is no possibility for claiming higher pension by you in my view.

probably not really, the first application is still valid, the more so that the right to the allowance has already been granted! snake game
