If Basic wages of an permanent employee is lesser than a contract labour, will it be violation of Minimum wages act?

It will be a violation of Minimum Wages Act not because the worker of the contractor is getting more than the wages of on roll worker but because an employer is not expected to pay any wages which is less than the notified minimum wages.

Legally no problem if the gross wages paid to both are not less than the MW fixed by the govt for the jobs.

But you will have HR problem.
