Hello Everyone,
I have read a lot about purpose of PF Form No. 11 on google and on citeHR, which is as follow-
(1) If the new joinee was earlier a member of PF and if yes, he should be given coverage even if his salary is more than Rs 15000
(2) If the new employee was not a member of PF in the past, he can be excluded in the present company also provided his PF qualifying salary exceeds Rs 15000. A person receiving PF pension or persons who have withdrawn the PF are also excluded employees.
Recently an PF Inspector visited our office and asked us to provide coverage to the employees who was previously a member of PF on a basic scale of Rs 15000. But some of our employees has already withdrawn their PF amount from their previous company.
As I have read, persons who have withdrawn the PF are also excluded employees, now how I should proof this statement in front of PF inspector.
Members I need your help in this regard, if any one can share any government petition on this will be a great help or share any other way to prove this statement.

On which basis the Inspector (Enforcement Officer) is requiring that those who have joined your establishment with a salary above Rs 15000 after full withdrawal of PF from the previous establishment? Is anything written in the form 11 that the employee was previously a member of PF?
An excluded employee as per definition is one who has withdrawn the PF accumulations on his attaining the age of superannuation or one who had to retire due to some injury etc. The Officer is right in demanding coverage if their withdrawal of PF was not been made on their attaining the age of superannuation or at the age of 55 years.
But once an employee has withdrawn his PF accumulations and also the Pension Fund, he is no longer a member of the PF. But sometimes they write in form 11 the details of their previous membership. This should have resulted in confusion. An employee who has withdrawn the PF and PS should not have written the details of his previous PF membership in form 11. If so, then you should have corrected it.
In respect of any employee whose salary is not more than Rs 15000 it is immaterial whether he was earlier a member or not. He should be given coverage now even if he had withdrawn his past accumulations.

Can I do the below Actions
1. Again, fill the PF form 11 from those who have withdrawn their previous PF and pension fund.
2. Will provide the PF coverage to remaining employees

Yes, you may collect a fresh form 11 from those who have joined with salary above Rs 15000, in which there should not be any mention about the previous PF Account.
